3. SERVICES PROVIDED & SCOPE

A. Process Serving Services

  • Standard of Performance: Legal Clarity performs service of process in compliance with applicable local, state, and federal laws.
  • Accuracy of Client Information: The client is solely responsible for providing accurate, legal, and complete information (e.g., valid addresses, proper subject identification, accurate court documents).
  • No Outcome Guarantee: Legal Clarity exercises diligent efforts to complete service. However, we do not guarantee successful service if a party evades service, provides fraudulent details, or cannot be located after reasonable diligence.

B. Loan Closing Agent Services

  • Independent Facilitation: As loan closing/notary signing agents, Legal Clarity acts as an independent contractor to facilitate document execution, notarization, and delivery.
  • No Loan Counseling: Agents will not provide financial opinions, interpret legal contract clauses, advise on mortgage terms, or direct signers beyond identifying signature, date, and notarization requirements.
  • Document Ownership: Document preparation, truth in lending disclosures, and overall compliance remain the sole responsibility of the lender, title company, or hiring agency.

4. PURCHASE OPTION & CANCELLATION POLICY (NONE)

  • Finality of Orders: All purchase options, service bookings, and orders submitted to 1982 LLC d/b/a Legal Clarity are final upon submission.
  • No Option to Cancel: Due to the immediate allocation of administrative prep, routing, and scheduling upon order receipt, there is no option for cancellation, withdrawal, or revocation by the client.
  • Strict Non-Refundable Policy: All fees paid are non-refundable. Fees remain non-refundable regardless of whether process service is successfully executed, evaded, or rendered unserviceable, or if a loan closing session is canceled or rescheduled by third parties.

5. SHIPPING & DELIVERY POLICY (NONE)

  • No Physical Goods Shipped: 1982 LLC d/b/a Legal Clarity exclusively offers professional services. We do not sell or ship physical retail products; therefore, no physical parcel shipping policy applies.
  • Service-Based Performance: Delivery occurs through direct field execution (in-person service or loan signing) and electronic delivery of proof of service, affidavits, or completion confirmations.
  • Document Transmittal: Physical court or loan packages provided for field execution are handled directly by authorized agents or via trackable overnight courier services (e.g., FedEx/UPS) specified by the hiring client or lender.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by law, 1982 LLC d/b/a Legal Clarity, its managing members, officers, employees, and independent contractors shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

  • Errors, omissions, or delays stemming from incorrect information supplied by the client or third parties.
  • Court dismissals, missed deadlines, or judicial rulings outside Legal Clarity’s direct operational control.
  • Delays or losses caused by third-party delivery services or court clerk delays.

These Terms of Service and any separate agreements under which we provide you services shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to any principles of conflicts of law.
