2. Service-Specific Terms
A. Service of Process
- Due Diligence & Compliance: Legal Clarity performs process serving in accordance with applicable local, state, and federal laws governing service of process.
- Accuracy of Information: Clients are solely responsible for providing accurate, complete, and lawful information (including valid party names, addresses, and legal documents) necessary to effectuate service.
- No Guarantee of Outcome: Legal Clarity makes reasonable, diligent attempts to execute service. However, we do not guarantee successful service if a recipient evades service, provides fraudulent information, or cannot be located after diligent efforts. Fees for attempted service remain non-refundable unless otherwise explicitly agreed in writing.
B. Loan Closing Agent Services
- Facilitation Only: As loan closing agents / notary signing agents, Legal Clarity acts as an independent contractor to facilitate the execution, notarization, and delivery of loan document packages.
- No Loan Counseling: Closing agents will not interpret legal documents, offer financial opinions, advise on loan terms, or direct parties on how to execute documents beyond identifying signature/notary requirements.
- Document Accuracy: Final responsibility for document preparation, accuracy, and lender compliance lies with the hiring lender, title company, or closing agency.
3. Limitation of Liability
To the maximum extent permitted by law, 1982 LLC, doing business as Legal Clarity, its officers, employees, agents, and contractors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to:
- Errors, omissions, or delays caused by inaccurate information provided by the client or third parties.
- Court decisions, dismissed actions, or missed deadlines resulting from circumstances outside Legal Clarity's direct control.
- Third-party courier or transmission delays.
In all events, any liability of 1982 LLC d/b/a Legal Clarity shall be limited strictly to the total amount paid by the client for the specific service in dispute.
4. Governing Law
This notice and all services provided by 1982 LLC d/b/a Legal Clarity shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
